ADN ENERGÍA, S. DE R.L. DE C.V. (hereinafter “ADN Energía”), with address at Avenida Lázaro Cárdenas, Number 2400, Interior Number A-13, Colonia Residencial de San Agustín, San Pedro Garza García, Nuevo León, México, C.P. 66260, presents this Privacy Notice, being responsible for the treatment and protection of your personal data, subject to the content herein.
The Personal Data that we collect from the Owner will be used for the following primary purposes:
(i) Verify and confirm his identity;
(ii) the provision of our services and products, among which are the supply of solid fuels, land logistics, technical and environmental advice, and advice on fuels and fuels;
(iii) integration as customers or business partners of ADN Energía in our databases;
(iv) the evaluation of all types of commercial and business proposals;
(v) attention to legal requirements of competent authorities;
(vi) the elaboration of all types of contracts and agreements that will come to be generated by any service relationship; and
(vii) the requirement of compliance with the obligations derived from them.
Additionally, ADN Energía may collect Personal Data for the following secondary purposes: (i) statistics, (ii) marketing, and (iii) commercial prospecting.
To carry out the purposes described above, we may request, where appropriate, the following personal data (hereinafter the "Personal Data"): identification, contact, labor, patrimonial and financial data. Said data may be collected by any means, including electronic, which will be subject at all times to the strictest confidentiality measures.
ADN Energía informs you that Personal Data may be shared within the country with the following persons for Primary and Secondary Purposes, and whose transfer does not require consent: the competent authorities for compliance with legal obligations derived from the contractual relationship between the Owner and ADN Energía; affiliated companies and subsidiaries of ADN Energía, both in Mexico and abroad; third-party service providers for compliance with the legal obligations acquired by ADN Energía or its affiliates and subsidiaries; business partners with whom ADN Energía or any of its affiliates and subsidiaries carry out agreements or contracts focused on the development of new products and/or services; third parties that request job references from former employees of any of the affiliated companies and subsidiaries of ADN Energía; third parties derived from a corporate restructuring; or other transmissions provided for and permitted by Law and its Regulations. Third parties and entities receiving personal data assume the same obligations and/or responsibilities of ADN Energía, in accordance with what is described in this Privacy Notice.
The administrative, technical and physical security measures necessary to ensure the integrity of the Personal Data, against damage, loss, alteration and/or destruction will be implemented. Likewise, the strictest confidentiality will be kept with respect to Personal Data and they will not be given a use other than those mentioned above.
The Holder has the right to know what personal data we have of the Holder, what we use them for and the conditions of use that we give them (ACCESS). Likewise, it is his right to request the correction of his personal information in case it is outdated, inaccurate or incomplete (RECTIFICATION); that we remove it from our records or databases when you consider that it is not being used properly (CANCELLATION); as well as oppose the use of your personal data for specific purposes (OPPOSITION). These rights are known as ARCO rights.
To exercise any of the ARCO rights, or to limit the use of their Personal Data, the Owner must submit a request via email to datospersonales@clisa.com addressed to the Personal Data Protection Committee. The Holder and, where appropriate, his representative, can prove his identity through any means, including electronic. The request to exercise any of the ARCO rights must contain: the name of the Holder, his address, and/or any other contact information to communicate the response to said request, documents that prove his identity (in the
form of a copy of the IFE or passport of the Holder), as well as the clear and precise description of the Personal Data with respect to which one seeks to exercise any of the ARCO rights, and any other element or document that facilitates the location of the Personal Data claimed. ADN Energía will respond to the requests it receives within the following 20 (twenty) business days, being able to communicate said response by any means, including electronic means.
